Welcome to 21 Cigar Company LLC, doing business as 21 Cigar Co. ("we", "us", or "our")! By accessing or using our Shopify storefront at bitcoincigars.com (the "Site") or purchasing our products (collectively, the "Services"), you agree to be bound by these Terms & Conditions ("Terms"). Our Services are available only to customers in the United States, its territories, and APO addresses. If you don’t agree with these Terms, please don’t use our Site or Services. We’re excited to share our premium cigars and accessories with you, so let’s dive into the details!

1. Age Restriction

Our products are for adults 21 and older, in compliance with federal, state, and local laws governing tobacco products. By placing an order, you confirm you are at least 21 years old. We use AgeChecker.Net to verify your age, and we may request government-issued ID at the time of purchase or delivery. If you can’t provide valid proof of age, we may cancel your order without a refund.

2. Products and Availability

We offer premium cigars and accessories (e.g., ashtrays, lighters, cutters, humidors) on our Site, subject to availability. We may limit quantities or discontinue products at any time without notice. Product descriptions, images, and prices are provided for your convenience, and we strive for accuracy. However, we’re not responsible for errors or omissions in this information. Due to the nature of cigars, individual flavor or quality may vary, and we cannot guarantee specific performance or satisfaction.

3. Orders and Payment

When you place an order, you agree to pay the total amount shown at checkout, including product prices, taxes, and shipping fees. We accept payments via Bankful (credit/debit cards) and BTC Pay Server (Bitcoin, processed through our own open-source instance hosted on a third-party cloud). You confirm that you’re authorized to use the payment method provided.

Orders are confirmed only after successful payment processing. We reserve the right to cancel or refuse any order, including for suspected fraud, non-compliance with these Terms, or other reasons. For Bitcoin payments, refunds (if applicable) will be issued based on the USD value of the transaction at the time of purchase.

4. Shipping and Delivery

We ship to addresses within the United States, its territories, and APO addresses, in compliance with applicable tobacco regulations. Some state or local laws may restrict shipping, and it’s your responsibility to ensure compliance.

Please double-check your shipping address, as we’re not liable for delays, losses, or extra costs due to incorrect address information. Delivery times are estimates, not guarantees, and we’re not responsible for delays caused by carriers, customs, or other factors beyond our control. All shipments require an adult signature (21+) upon delivery to comply with tobacco regulations.

5. Returns and Refunds

Due to the perishable and consumable nature of premium cigars, all sales are final except in cases of damaged-in-transit or defective products. Please see our full Return Policy for details on eligibility, timeframes, and how to submit a claim for damaged or defective items (e.g., cigars crushed in transit or defective accessories). Returns or refunds are not available for buyer’s remorse, dissatisfaction with flavor, incorrect selections, customs confiscations, or final-sale items.

6. Compliance with Laws

You are responsible for complying with all federal, state, and local laws regarding the purchase, possession, and use of tobacco products. We’re not liable for any legal consequences resulting from your purchase or use of our products in violation of these laws. Tobacco use carries health risks, and you assume all risks associated with using our products.

7. Intellectual Property

All content on our Site, including logos, images, product descriptions, and text, is owned by or licensed to 21 Cigar Company LLC. You may not copy, reproduce, distribute, or use our content without our prior written permission.

8. Limitation of Liability

To the fullest extent permitted by law, 21 Cigar Company LLC is not liable for any indirect, incidental, or consequential damages arising from your use of the Site, Services, or products, including but not limited to damages from product misuse, health risks associated with tobacco use, or dissatisfaction with product quality. Our total liability for any claim will not exceed the amount you paid for the product(s) in question.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Florida and applicable federal laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Site will be resolved in the state or federal courts located in Walton County, Florida, and you consent to the jurisdiction of these courts.

11. Changes to Terms

We may update these Terms from time to time by posting the revised version on our Site. Changes will apply to orders placed after the “Last updated” date. Your continued use of the Site or Services after changes means you accept the updated Terms.
